1. General terms and conditions

 

1. Scope of application

The present General Terms and Conditions (GTC) regulate the contractual relationship between the

(hereinafter referred to as "Provider") and the users (hereinafter referred to as "Customers") of its digital products.

2. Conclusion of the contract

The contract for the acquisition of a digital product is concluded when the customer orders the corresponding product in the provider's online shop and the provider confirms the order.

3. Delivery

The delivery is made exclusively in digital form. After a successful order, the customer will receive access to the digital product via a personalized download link.

 

2. Prices and payment terms

All prices include the statutory value-added tax.

2. Payment terms

The payment can be made via PayPal in the provider's online shop.

3. Due date

The purchase price is due immediately after the conclusion of the contract.

3. Usage rights

 

1. Granting of usage rights

The provider grants the customer a non-exclusive, non-transferable, and unlimited time usage right to the acquired digital products. This right includes use for private and business purposes.

2. Restrictions

The customer is not allowed to change, reproduce, distribute or make the digital products publicly accessible, either in whole or in part, unless this is expressly permitted or legally allowed.

3. Copyrights

All copyright for the digital products remains with the provider. Any reproduction or other use of the products without the provider's permission is prohibited.

4. Liability limitations

 

1. Disclaimer

The provider is not liable for damages caused by the use of the digital products, unless they are based on intent or gross negligence by the provider.

2. Scope of Liability

The provider's liability is limited to the foreseeable, typical contractual damage. Liability for indirect damage or lost profits is excluded.

 

5. Changes and termination

 

1. Changes to the Terms and Conditions

The provider reserves the right to change these terms and conditions at any time and without giving reasons. The amended terms and conditions will be communicated to the customer in a timely manner before they come into effect either by email or through a publication on the provider's website.

 

2. Termination

The customer can terminate the contract at any time without giving reasons. Amounts already paid will not be refunded.

 

 

6. Withdrawal declaration for digital content (e.g. downloads)

 

1. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without stating any reasons. The withdrawal period is fourteen days from the date of conclusion of the contract.

To exercise your right of withdrawal, you must inform us, AlhatsDesigns GbR, by email: Info@alhatsdesigns.com, with a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract.

To maintain the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period expires.

2. Consequences of the withdrawa

. If you revoke this contract, we will promptly and at the latest within fourteen days of the day on which the notification of your revocation of this contract has been received by us, refund all payments received from you. For this refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.

 

3. Expiration of the right of withdrawal

The right of withdrawal expires in the case of a contract for the supply of digital content that is not provided on a tangible medium (downloads) if we have begun the execution of the contract after you have expressly agreed that we may begin the execution of the contract before the withdrawal period has expired and you have acknowledged that by agreeing to the commencement of the execution of the contract, you lose your right of withdrawal.

7. Final provisions

 

1. Validity

Should individual provisions of these terms and conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

 

2. Applicable Law and Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Sales Convention. In case of disputes arising from or in connection with these General Terms and Conditions, the court at our location shall have jurisdiction, unless mandatory legal provisions dictate otherwise.
